Terms of Service for Novelpia Global

Welcome to Novelpia Global! These Terms of Service ("Terms") govern your access to and use of our platform, services, and content. By using our platform, you agree to abide by these Terms. If you do not agree, please do not use Novelpia Global.

1. Definitions

• Platform: Novelpia Global, including its website, mobile applications, and associated services.
• User: Any person who accesses or uses the Platform.
• Content: Any text, images, videos, audio, or other materials uploaded, posted, or displayed on the Platform.
• Author: A User who creates and publishes Content on the Platform.
• Reader: A User who reads or interacts with Content on the Platform.
• Monetization Program: Any revenue-sharing program for Authors.

2. Account Registration and Use

1. Users must be at least 13 years old to create an account. If under 18, a parent or legal guardian consent may be required depending on local laws of.
2. Users agree to provide accurate and up‑to‑date information upon registration.
3. Each User is responsible for maintaining the confidentiality of their account credentials.
4. Novelpia Global reserves the right to suspend or terminate accounts for violations of these Terms.

3. User Conduct

Users agree not to:

1. Violate any applicable international, national, or local laws or regulations.
2. Post Content that is illegal, defamatory, obscene materials prohibited by law, hateful, or infringes on intellectual property rights.
3. Engage in harassment, threats, or abuse toward other Users.
4. Use automated bots, scripts, or any unauthorized methods to access the Platform.
5. Attempt to hack, disrupt, or manipulate the Platform.
6. Engage in fraudulent activities, such as artificially inflating views or earnings.
7. Violation of any of the above terms may result in restrictions being placed on the user's account and site activities.

4. Content Ownership and Licensing

1. Authors retain ownership of their original Content.
2. By posting content, the Author grants Novelpia Global a worldwide, non‑exclusive, royalty‑free license to use the content for the purposes of operating the service, marketing, and content promotion.
3. The Platform may modify or remove Content that violates these Terms.
4. Users may not copy, reproduce, or distribute Content without permission from the rightful owner.

5. Monetization and Payments

1. Authors may participate in revenue‑sharing programs as specified in separate agreements.
2. Earnings will be distributed according to the Platform’s revenue policies.
3. The Platform reserves the right to withhold or adjust payments in case of fraudulent activity or violations of these Terms.
4. Taxes and other legal financial obligations are the responsibility of the Authors based on their respective country’s tax regulations.

6. Copyright and Intellectual Property

1. Users may not upload Content that infringes on the intellectual property rights of others.
2. Novelpia Global complies with applicable copyright laws, including the Digital Millennium Copyright Act (DMCA) for U.S.-based claims.
3. Users may file copyright claims via the Platform’s designated contact method.

DMCA Notification Procedure

If you believe that your copyrighted work has been infringed upon, you may submit a DMCA takedown request to our designated Copyright Agent. The request must include:

1. A physical or electronic signature of the copyright owner or a person authorized to act on their behalf.
2. Identification of the copyrighted work that has been allegedly infringed.
3. Identification of the infringing material, including a URL or sufficient detail to locate the content.
4. Contact information of the complaining party, including address, telephone number, and email address.
5. A statement that the complaining party has a good faith belief that use of the material is not authorized by the copyright owner, its agent, or the law.
6. A statement, under penalty of perjury, that the information provided is accurate and that the complaining party is authorized to act on behalf of the copyright owner.

If a User’s Content is subject to a DMCA takedown request, they may file a counter‑notification if they believe the removal was made in error. The counter‑notification must comply with DMCA guidelines.

7. Subscription Plans and Upgrades

1. Plans are available as auto‑renewing subscriptions and are billed on a recurring basis.
2. The Premium Plan includes all features of the Ad‑Free Plan in addition to exclusive premium content and/or enhanced platform features.
3. Users currently subscribed to the Ad‑Free Plan may upgrade to the Premium Plan at any time. The upgrade will take effect immediately, and the price difference may be prorated based on the remaining billing cycle.
4. Downgrades from Premium to Ad‑Free (or to a free tier, if available) will take effect at the end of the current billing period.
5. All charges include applicable taxes and third‑party processing fees. Users authorize Novelpia Global to store their payment information for future billing.
6. If a payment fails, Novelpia Global may retry billing and/or temporarily suspend Premium services until payment is resolved.
7. Novelpia Global reserves the right to modify plan offerings, features, or pricing at any time. Any such changes will be communicated in advance where required by applicable law.

8. Refund and Cancellation Policy

1. Digital Content Purchases: All sales of digital content (including but not limited to e-books, stories, and premium subscriptions) are final and non-refundable unless required by applicable law.
2. Subscription Cancellations:
   • Users may cancel subscriptions at any time through their account settings.
   • Cancellations take effect at the end of the current billing cycle, and no refunds will be issued for partially used periods.
3. Unauthorized Transactions:
   • If you believe an unauthorized transaction has occurred, please contact our support team within 7 days of the transaction.
   • We reserve the right to investigate and, if necessary, issue a refund at our sole discretion.
4. Exceptional Cases:
   • Refunds may be granted in exceptional cases such as accidental duplicate purchases or proven technical issues preventing content access.
   • Any refund requests must be submitted within 14 days of purchase.

9. Termination and Account Suspension

1. Novelpia Global reserves the right to suspend or terminate accounts without prior notice for violations of these Terms.
2. Users may request account deletion through the Platform’s support team.
3. Termination of an account does not absolve Users from financial or legal obligations incurred before termination.

10. Disclaimers and Limitation of Liability

1. Novelpia Global provides services "as is" without warranties of any kind.
2. The Platform is not liable for Content posted by Users.
3. Novelpia Global is not responsible for service interruptions, data loss, or security breaches beyond its control.
4. Users agree to indemnify Novelpia Global from any legal claims arising from their use of the Platform.
5. The Platform does not guarantee financial success or audience reach for Authors using monetization programs.
6. Novelpia Global is not responsible for third‑party services or content linked to or from the Platform.

11. Modifications to These Terms

1. Novelpia Global may update these Terms at any time; however, users will be notified of significant changes through email or platform notifications.
2. Continued use of the Platform after updates constitutes acceptance of the revised Terms.

12. Governing Law and Dispute Resolution

1. These Terms are governed by the laws of the jurisdiction where Novelpia Global is registered.
2. Any disputes shall be resolved through arbitration in the competent jurisdiction prior to any formal litigation, unless otherwise required by applicable law.
3. The jurisdiction over lawsuits related to disputes shall lie with the Seoul Central District Court of the Republic of Korea.
